TO AMEND ARTICLE 31, CHAPTER 5, TITLE 56, CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-5-3895 SO AS TO PROHIBIT A PERSON FROM OPERATING A MOTOR VEHICLE WHILE USING A MOBILE OR CELLULAR PHONE AND TO PROVIDE PENALTIES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 31, Chapter 5, Title 56 of the 1976 Code is amended by adding:
"Section 56-5-3895. (A) It is unlawful for a person to operate a motor vehicle while using a mobile or cellular phone in this State.
(B) A person who violates subsection (A) is guilty of a misdemeanor and, upon conviction, must be fined not more than one hundred dollars or imprisoned for not more than thirty days for a first offense. A person convicted of a second offense must be fined not more than one hundred fifty dollars or imprisoned for not more than sixty days. A person convicted of a third or subsequent offense must be fined not less than two hundred fifty dollars nor more than one thousand dollars or imprisoned for not less than ninety days nor more than one year.
(C) The provisions of subsection (A) do not apply to a person using a mobile or cellular phone while travelling as a passenger in a motor vehicle or to a person using a cellular or mobile phone while in a parked or otherwise stationary vehicle at rest upon the shoulder of a state or local roadway, parking lot, or rest area."
SECTION 2. This act takes effect upon approval by the Governor.
