REQUESTING THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL TO REPEAL REGULATION 61-57 REGULATING THE DEVELOPMENT OF SUBDIVISION WATER SUPPLY AND SEWAGE TREATMENT AND DISPOSAL SYSTEMS OR IN THE ALTERNATIVE TO SUSPEND IMPLEMENTATION OF THIS REGULATION UNTIL FURTHER STUDY CAN BE CONDUCTED TO ASCERTAIN THE IMPACT OF THIS REGULATION ON SUBDIVISION DEVELOPMENT.
Whereas, the Department of Health and Environmental Control Regulation 61-57 was implemented in September, 2000, following its adoption in February of 2000, for the purpose of revising application and approval procedures for subdivision water supply and sewage treatment and disposal systems to establish public notice requirements for all subdivision sewage treatment disposal systems; and
Whereas, the South Carolina House of Representatives finds the requirements of Regulation 61-57 to be burdensome and to place an undue impact on the development process; and
Whereas, the South Carolina House of Representatives finds the requirements of Regulation 61-57 to provide arbitrary and unreasonable measures that can be used by opponents to delay and impede subdivision developments that otherwise meet all state and local standards; and
Whereas, the South Carolina House of Representatives finds the requirements of Regulation 61-57 to not bear a close relationship with the preservation or protection of the public health, safety, or welfare. Now, therefore,
Be it resolved by the House of Representatives:
That, by this resolution, the members of the South Carolina House of Representatives request the Department of Health and Environmental Control to repeal Regulation 61-57 or in the alternative to suspend implementation of this regulation until further study can be conducted to ascertain the impact of this regulation on subdivision development.
Be it further resolved that a copy of this resolution be forwarded to the Commissioner of the Department of Health and Environmental Control.
