TO AMEND TITLE 41, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO LABOR AND EMPLOYMENT BY ADDING CHAPTER 14, SO AS TO ENACT THE BOILER STANDARDS ACT WHICH REQUIRES ANY BOILER INSTALLED AFTER DECEMBER 31, 2001, TO BE DESIGNED, MANUFACTURED, AND SEALED OR STAMPED UNDER THE BOILER AND PRESSURE VESSEL CODE OF THE AMERICAN SOCIETY OF MECHANICAL ENGINEERS, TO AUTHORIZE VARIANCES, TO PROVIDE THAT COMPLAINTS AND BOILER INCIDENTS MAY BE REPORTED TO THE STATE ENGINEER TO BE INVESTIGATED, AND TO PROVIDE THAT A PERSON IN VIOLATION OF THIS ACT IS SUBJECT TO A FIVE THOUSAND DOLLAR FINE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Title 41 of the 1976 Code is amended by adding:
Section 41-14-10. This chapter may be cited as the 'Boiler Standards Act'.
Section 41-14-20. (A) A boiler installed in this State after December 31, 2001, must be designed, manufactured, and sealed or stamped under the Boiler and Pressure Vessel Code of the American Society of Mechanical Engineers.
(B) For purposes of this section 'boiler' means a closed vessel in which water or other liquid is heated, steam or vapor is generated, steam is superheated, or in which any combination of these functions is accomplished under pressure or vacuum, for use external to itself, by the direct application of energy from the combustion of fuels or from electricity, solar, or other energy. 'Boiler' includes the apparatus by which heat is generated and all controls and safety devices associated with the apparatus or the closed vessels. 'Boiler' includes fired units for heating or vaporizing liquids other than water where the units are separate from processing systems and are complete within themselves. 'Boiler' does not include a pressure vessel.
Section 41-14-30. A person required to comply with this chapter may apply to the Budget and Control Board, State Engineer, for a permanent variance from provisions of this chapter or from any nationally recognized code applied under this chapter. The State Engineer shall issue a variance if he determines that the conditions, practices, means, methods, materials, or operations proposed to be used will provide the public with conditions which are as safe as those which would prevail if the person seeking the variance complied with this chapter or a nationally recognized code applied under this chapter. The variance must prescribe the conditions that must be maintained and utilized to the extent that they differ from the provisions of this chapter.
Section 41-14-40. Complaints of alleged violations of Section 41-14-20 and incidents involving boilers subject to this chapter may be reported to the Budget and Control Board, State Engineer who shall investigate these complaints and incidents.
Section 41-14-50. A person who violates Section 41-14-20 is subject to a civil penalty of not more than five thousand dollars to be imposed by the State Engineer upon a finding of a violation."
SECTION 2. This act takes effect upon approval by the Governor.
