TO AMEND SECTION 56-1-40, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PERSONS WHO MAY NOT BE ISSUED A DRIVER'S LICENSE OR HAVE THEIR DRIVER'S LICENSE RENEWED, SO AS TO PROVIDE THAT PERSONS FROM OTHER COUNTRIES WHO ARE PRESENT IN SOUTH CAROLINA WHO POSSESS ONE OF SEVERAL SPECIFIED FORMS OF DOCUMENTATION THAT PROVES THAT THEY ARE IN THE STATE LEGALLY MAY OBTAIN A DRIVER'S LICENSE OR HAVE THEIR DRIVER'S LICENSE RENEWED.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 56-1-40(7) of the 1976 Code, as last amended by Act 497 of 1994, is further amended to read:
"(7) who is not a resident of South Carolina, except for persons from other countries who are present in South Carolina:
(a) on a student visa or on a work visa or the dependents of the student or worker who may be issued a license.;
(b) whose passport contains a stamp that shows a green card has been approved by the United States Immigration and Naturalization Service;
(c) who possess an employment authorization card;
(d) who possess proof that their green card application is pending; or
(e) who possess a temporary resident card.
However, The granting of the a license pursuant to this item is not evidence of meeting the residency requirements of Section 59-112-20;"
SECTION 2. This act takes effect upon approval by the Governor.
