A JOINT RESOLUTION

INSTRUCTING THE SOUTH CAROLINA LOTTERY COMMISSION TO ENFORCE, IMMEDIATELY UPON DEFAULT OR BREACH BY A LOTTERY VENDOR OF A CONTRACT ENTERED INTO BETWEEN THE COMMISSION AND THE VENDOR, A LIQUIDATED DAMAGES PROVISION OR A PROVISION FOR LATE FINES OR PENALTIES IN THE CONTRACT, A PERFORMANCE OR BID BOND, A LETTER OF CREDIT SECURING THE PERFORMANCE OR BID, OR SPECIFIC PERFORMANCE OF THE SUBJECT CONTRACT PROVISION, AND TO PROVIDE FOR A MONTHLY REPORT TO THE STATE BUDGET AND CONTROL BOARD OF THE STATUS OF THE PERFORMANCE OF EACH CONTRACT IN EFFECT BETWEEN THE COMMISSION AND A LOTTERY VENDOR.

Whereas, the South Carolina Lottery Commission is authorized to enter into contracts with lottery vendors for the supply of all the tangible and intangible components necessary to the timely implementation and operation of a successful South Carolina Education Lottery; and

Whereas, failure by a lottery vendor to perform a contractual duty results in vital revenues being lost to the state's educational purposes and programs; and

Whereas, it is the duty of the South Carolina Lottery Commission to take all steps available to it to ensure the success of the Education Lottery in fully funding the state's educational purposes and programs. Now, therefore,

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    The South Carolina Lottery Commission is instructed to enforce, immediately upon default or breach by a lottery vendor of a contract entered into between the commission and the vendor, a liquidated damages provision or a provision for late fines or penalties in the contract, a performance or bid bond, a letter of credit securing the performance or bid, or specific performance of the subject contract provision.

    The commission shall provide a monthly report to the State Budget and Control Board of the status of the performance of each contract in effect between the commission and a lottery vendor.

SECTION    2.    This joint resolution takes effect upon approval by the Governor.
