A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 44-6-157 SO AS TO ESTABLISH WITHIN THE STATE DEPARTMENT OF HEALTH AND HUMAN SERVICES THE UNINSURED MEDICAL CATASTROPHE FUND FOR THE PURPOSE OF RECEIVING CONTRIBUTIONS DESIGNATED ON STATE INDIVIDUAL INCOME TAX RETURNS TO PROVIDE ACCESS TO TREATMENT FOR UNINSURED MEDICAL CATASTROPHES AND TO REQUIRE THE DEPARTMENT TO DEVELOP GUIDELINES FOR ELIGIBILITY; AND TO AMEND SECTION 12-6-5060, AS AMENDED, RELATING TO VOLUNTARY CONTRIBUTIONS MADE BY DESIGNATIONS ON THE STATE INDIVIDUAL INCOME TAX RETURN, SO AS TO INCLUDE A DESIGNATION FOR THE UNINSURED MEDICAL CATASTROPHE FUND.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 2, Chapter 6, Title 44 of the 1976 Code is amended by adding:

    "Section 44-6-157.    There is created under the administration of the department the Uninsured Medical Catastrophe Fund to receive contributions made pursuant to Section 12-6-5060 and otherwise to provide assistance to residents of this State who suffer medical catastrophes and who have no health insurance for the needed treatment. The department shall develop the eligibility criteria and these criteria need not conform to Medicaid eligibility requirements. The department shall receive and review applications for assistance and grant such assistance to the extent revenues of the fund are sufficient to meet the expenses. Revenues in the fund remain in the fund and are carried forward in it to succeeding fiscal years and must be used for the same purposes. Interest earned on the fund must be credited to it."

SECTION    2.    Section 12-6-5060(A) of the 1976 Code, as last amended by Act 387 of 2000, is further amended to read:

    "(A)    Each taxpayer required to file a state individual income tax return may contribute to the War Between the States Heritage Trust Fund established pursuant to Section 51-18-115, the Nongame Wildlife and Natural Areas Program Fund, the Children's Trust Fund of South Carolina established pursuant to Section 20-7-5010, the Eldercare Trust Fund of South Carolina established pursuant to Section 43-21-160, the Uninsured Medical Catastrophe Fund established pursuant to Section 44-6-157, or the First Steps to School Readiness Fund established pursuant to Section 20-7-9740 by designating the contribution on the return. The contribution may be made by reducing the income tax refund or by remitting additional payment by the amount designated."

SECTION    3.    This act takes effect upon approval by the Governor and applies for state individual income tax returns for the 2002 taxable year.
