A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-101-275 SO AS TO REQUIRE PUBLIC AND PRIVATE INSTITUTIONS OF HIGHER LEARNING IN THIS STATE TO VERIFY WHETHER EACH STUDENT IS A UNITED STATES CITIZEN OR IN POSSESSION OF A VALID VISA BEFORE BEING ENROLLED.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 59-101-275. All public and private institutions of higher learning shall verify that a student is a United States citizen or in possession of a valid visa before being enrolled. If the visa has expired or is otherwise invalid, the school shall notify the Immigration and Naturalization Service and the Federal Bureau of Investigation."

SECTION 2. This act takes effect upon approval by the Governor.
