EXPLANATION OF IMPACT:

    The Department of Public (DPS) states there would be no impact on the General Fund of the State, as it merely authorizes the Division of Motor Vehicles (DMV) to enter into contracts with the specified entities.

    Assuming DMV undertook to contract out certain services, the division would have to conduct contract negotiations to determine whether there would be added costs or savings associated with contracting with and the supervision of the parties who would provide the services.

A BILL

TO AMEND SECTION 23-6-300, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE CREATION OF FUNCTIONS, DUTIES, AND RESPONSIBILITIES OF THE DEPARTMENT OF PUBLIC SAFETY'S MOTOR VEHICLE DIVISION, SO AS TO PROVIDE THAT THE MOTOR VEHICLE DIVISION MAY ENTER INTO CONTRACTS WITH PRIVATE SECTOR BUSINESSES TO PROVIDE MOTOR VEHICLE REGISTRATION AND TITLING SERVICES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 23-6-300 of the 1976 Code, as last amended by Act 459 of 1996, is further amended to read:

    "Section 23-6-300.    (A)    There is created a Motor Vehicle Division within the department. The division shall be is responsible for all of those functions, duties, and responsibilities previously exercised by and/or or operating under the Division of Motor Vehicles of the South Carolina Department of Highways and Public Transportation, or both.

    (B)    The Motor Vehicle Division may enter into contracts with private-sector businesses to provide motor vehicle registration and titling services."

SECTION    2.    This act takes effect upon approval by the Governor.
