A BILL

TO AUTHORIZE THE SPARTANBURG COUNTY COUNCIL TO EMPOWER THE HEAD OF THE SPARTANBURG COUNTY DETENTION FACILITY TO APPOINT LAW ENFORCEMENT OFFICERS, WITH THE APPROVAL OF THE COUNTY ADMINISTRATOR, TO OVERSEE THE JAIL AND TO HAVE THE AUTHORITY OF A PEACE OFFICER TO PATROL AND MAKE ARRESTS ON ALL COUNTY PROPERTY INCLUDING THE DETENTION FACILITY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    (A)    Notwithstanding any other provision of law, the Spartanburg County Council shall empower the head of the Spartanburg County Detention Facility, with the approval and concurrence of the county administrator, to appoint an appropriate number of law enforcement officers, to be no greater than the number of officers as approved in the county's annual budget, to oversee the jail and to have the general police authority of a peace officer to patrol and when necessary make arrests on all county property and in all county buildings including, the county detention facility. There officers also have the authority of a constable, in accordance with Section 23-1-60, to make arrests for any crime committed in their presence while in the performance of their official duties. These officers shall demonstrate knowledge and training as a law enforcement officer or shall take a course of training as approved by the chief of the State Law Enforcement Division for nonpaid constables.

    (B)    No officer appointed pursuant to this act shall assume any duties of the Office of the Sheriff. However, nothing contained in this act precludes the sheriff, in his sole discretion, from contracting either verbally or in writing with the officers appointed pursuant to subsection (A) to assist him or his deputies as the sheriff considers appropriate.

    (C)    The authority granted to officers under this act ends upon the termination of the officer's employment unless otherwise authorized by law."

SECTION    2.    This act takes effect upon approval by the Governor.
