REPORT:

    That they have duly and carefully considered the same and recommend that the same do pass with amendment:

    Amend the joint resolution, as and if amended, by striking SECTION 2 and inserting:

    / SECTION    2.    This act takes effect July 1, 2002. /

    Renumber sections to conform.

    Amend title to conform.

STATEMENT OF ESTIMATED FISCAL IMPACT

REVENUE IMPACT1/

    This bill is not expected to impact general fund revenues in FY2001-02 or FY2002-03. This bill is expected to reduce funds directed to the Department of Health and Human Services by $7,900,000 in FY2001-02 and by $26,100,000 in FY2002-03.

Explanation

    This bill would repeal H.B. 4498 (R 176) which imposed, effective February 1, 2002, a $3 per patient day franchise fee on nursing homes licensed by the Department of Health and Environmental Control (DHEC). R 176 raised this nursing home franchise fee to $4 per patient day effective July 1, 2002. Fees were to be collected by the Department of Revenue (DOR), remitted to the State Treasurer, and credited to the Department of Health and Human Services (DHHS). In a fiscal impact dated January 23, 2002, the BEA estimated that R 176 would generate an estimated $7.9 million in nursing home franchise fees in FY2001-02 and an estimated $26.1 million in FY2002-03. Therefore, the BEA estimates that repeal of R 176 would reduce other fund revenue collected by DOR, remitted to the State Treasurer, and credited to DHHS by an estimated $7,900,000 in FY2001-02 and by an estimated $26,100,000 in FY2002-03.

A BILL

TO REPEAL A JOINT RESOLUTION OF 2002 BEARING RATIFICATION NUMBER 176, ESTABLISHING AN ANNUAL NURSING HOME FRANCHISE FEE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    A joint resolution of 2002 bearing ratification number 176 is repealed.

SECTION    2.    This act takes effect upon approval by the Governor.
