A BILL

TO AMEND SECTION 5-31-240, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE QUALIFICATION AND ORGANIZATION OF A COMMISSION OF PUBLIC WORKS, SO AS TO DELETE THE REQUIREMENT THAT THE CLERK OR RECORDER OF THE MUNICIPALITY ACT AS SECRETARY OF THE COMMISSION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 5-31-240 of the 1976 Code is amended to read:

"Section 5-31-240.    The mayor of the city or the mayor or intendant of the town municipality shall notify the persons so elected as members of the commissioners Commission of Public Works of their election, within ten days after the results of such the election are declared. The persons elected or appointed to such the office shall qualify by taking the same oath as the elected officers of the municipality take. At the first meeting of the commissioners after the election, and after any election for a full term, they shall organize by the election of one of their number as chairman. The clerk or recorder of the municipality shall act as secretary of the commissioners. The mayor and aldermen or council of the city or the mayor or intendant and the council or wardens of a town municipality shall fill any a vacancy occurring in the commission by appointment for the unexpired term."

SECTION    2.    This act takes effect upon approval by the Governor.
