TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 12-21-4275 SO AS TO PROHIBIT THE DISTRIBUTION OF BINGO CARDS TO AN UNLICENSED PERSON AND TO PROVIDE FOR PERMANENT LICENSE REVOCATION FOR UNAUTHORIZED DISTRIBUTION; AND TO AMEND SECTION 12-21-3940, RELATING TO A LICENSE TO CONDUCT BINGO, SO AS TO INCREASE TO FORTY-FIVE THE NUMBER OF DAYS THE DEPARTMENT OF REVENUE HAS BEFORE ACCEPTANCE OR REJECTION OF AN APPLICATION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 24, Chapter 21, Title 12 of the 1976 Code is amended by adding:
"Section 12-21-4275. A bingo manufacturer may not distribute cards to a person not licensed as a distributor. A distributor may not distribute cards to a person not licensed pursuant to Section 12-21-4020. The department shall revoke permanently the license of a distributor who releases cards without written authorization from the department. If a license is revoked pursuant to this section, the department may not issue another distributor license to any person, directly or indirectly, individually or as a member of a partnership, corporation, or association, or as a relative by blood or marriage within the second degree, to a person or organization that had an interest in the revoked license."
SECTION 2. Section 12-21-3940(B) of the 1976 Code is amended to read:
"(B) Upon application for a license, the department has thirty forty-five days to approve or reject the application based on the requirements of this article."
SECTION 3. This act takes effect upon approval by the Governor.
