AN ACT TO AMEND SECTION 50-13-1135, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO COMMERCIAL OR NONCOMMERCIAL FISHING LICENSES REQUIRED FOR TAKING NONGAME FISH IN FRESHWATERS WITH CERTAIN FISHING DEVICES, SO AS TO PROVIDE THAT A JUG PERMIT IS NOT REQUIRED FOR RESIDENTS ASSISTING JUG PERMIT HOLDERS.

Be it enacted by the General Assembly of the State of South Carolina:

Jug permits not required

SECTION    1.    Section 50-13-1135(A)(2) of the 1976 Code, as last amended by Act 350 of 1994, is further amended to read:

"(2)    A noncommercial fisherman shall purchase set hook or jug fishing permits and tags required by this article for the particular device used. Tags and permits may be applied for on forms provided by the department. This fisherman shall comply with other provisions of this article pertaining to the marking and use of nongame fishing devices. A jug permit is not required for residents assisting jug permit holders."

Time effective

SECTION    2.    This act takes effect upon approval by the Governor.

Ratified the 24th day of May, 2005.

Approved the 26th day of May, 2005.
