A BILL

TO AMEND SECTION 48-39-150, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO CRITERIA FOR THE ISSUANCE OF PERMITS UNDER THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL'S COASTAL MANAGEMENT PROGRAM, SO AS TO DELETE AS A CONSIDERATION IN ISSUING SUCH PERMITS THE EXTENT TO WHICH THE PROPOSED USE, PURSUANT TO THE PERMIT, COULD AFFECT THE VALUE AND ENJOYMENT OF ADJACENT OWNERS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 48-39-150(A) of the 1976 Code, as amended by Act 181 of 1993, is further amended by deleting item (10) which reads:

"(10)    The extent to which the proposed use could affect the value and enjoyment of adjacent owners."

SECTION    2.    This act takes effect upon approval by the Governor.
