A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 44-6-75 SO AS TO REQUIRE THE DEPARTMENT OF HEALTH AND HUMAN SERVICES, RATABLY OVER FIVE YEARS, TO CONFORM THE STATE MEDICAID MONTHLY MAINTENANCE NEEDS ALLOWANCE TO THE MOST CURRENT MAXIMUM AMOUNTS ALLOWED UNDER FEDERAL LAW.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 1, Chapter 6, Title 44 is amended by adding:

"Section 44-6-75.    The department, phased-in ratably over five years, shall conform the state Medicaid Monthly Maintenance Needs Allowance to the most current maximum amounts authorized by the federal government. The department may utilize, to the extent necessary, general funds appropriated to the agency annually in the general appropriations act to implement the provisions of this section."

SECTION    2.    This act takes effect July 1, 2005.
