A BILL

TO AMEND SECTION 30-4-70, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE AUTHORITY OF A PUBLIC BODY HOLDING A MEETING CLOSED TO THE PUBLIC, SO AS TO REQUIRE THE PUBLIC BODY TO FORWARD TO THE SOLICITOR INCIDENTS OF ALLEGED CRIMINAL MISCONDUCT AND THE SOLICITOR HAS REQUESTED THE DISCUSSION OF THIS MATTER BE HELD IN A CLOSED MEETING IN ORDER FOR THE MATTER TO BE DISCUSSED IN A CLOSED MEETING.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 30-4-70(a)(4) of the 1976 Code is amended to read:

"(4)    Investigative proceedings regarding allegations of criminal misconduct. However, the meeting may not be closed to the public unless allegations have been forwarded to the solicitor and the solicitor requests the matter be discussed in a closed meeting."

SECTION    2.    This act takes effect upon approval by the Governor.
