A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-1-385 SO AS TO CREATE THE BEAUFORT-JASPER ACADEMY FOR CAREER EXCELLENCE BOARD OF TRUSTEES AND TO PROVIDE FOR THE APPOINTMENT, TERM, ATTENDANCE, AND REMOVAL OF ITS MEMBERS; TO PROVIDE FOR THE OPERATION, GOVERNANCE, AND COMPENSATION OF THE BOARD; TO PROVIDE THAT BEGINNING JULY 1, 2006, THE BEAUFORT COUNTY SCHOOL DISTRICT SHALL MANGE THE ACADEMY; AND TO PROVIDE THAT BEGINNING OCTOBER 1, 2006, JASPER COUNTY SHALL SUBMIT PAYMENT TO BEAUFORT COUNTY BASED ON A PER STUDENT COST.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 1, Chapter 1, Title 59 of the 1976 Code is amended by adding:

"Section 59-1-385.    (A)(1)    There is established the Board of Trustees for the Beaufort-Jasper Academy for Career Excellence Board to be composed of the following:

(a)    two members of the Beaufort County School Board, who shall serve ex officio, to be appointed by the members of the Beaufort County School Board; one member must represent that area North of the Broad River and one must represent that area South of the Broad River;

(b)    two members of the Jasper County School Board, who shall serve ex officio, to be appointed by the Jasper County School Board; one member must represent Ridgeland and one must represent Hardeeville;

(c)    five members with business or industry experience to be appointed by the Beaufort-Jasper legislative delegation; one member must be selected from Beaufort, one from Bluffton/Okatie, one from Hilton Head, one from Hardeville, and one from Ridgeland;

(d)    the superintendents of Beaufort County and Jasper County Schools, who shall serve ex officio.

(2)    Members take office January 1, 2006 and shall serve terms of four years. Terms of members appointed pursuant to subsection (A)(1) shall serve terms commensurate with their school board terms; however, of the initial members appointed from the school boards, a member who has fewer than four years, but two or more years remaining in his or her school board term, may serve a term of two years. Members continuing to serve on the respective school boards may be reappointed.

(3)    Vacancies on the board must be filled in the manner of the original appointment for the unexpired portion of the term.

(B)    Annually at the first meeting of the board, the members shall elect a chairman, vice chairman, secretary, and Chaplin for terms of one year. Officers may be reelected a maximum of four terms.

(C)    The chairman of the board shall appoint members to serve on such committees as may be necessary to carry out the duties of the board and may include, but are not limited to, the curriculum committee and the facilities committee.

(D)    The academy board shall meet quarterly and at such other times as may be called by the chairman of the board.

(E)    A member who does not attend at least seventy per cent of the meetings is subject to removal by the appointing authority. The secretary of the board shall maintain attendance records and shall report excess absences to the appointing authority.

(F)    Members shall receive compensation commensurate with that paid to Beaufort County School Board members.

(G)    Beginning July 1, 2006, the Beaufort County School District shall manage the academy under the governance of the board of trustees, as established pursuant to subsection (A).

(H)(1)    From July 1, 2006, through September 30, 2006, Jasper County shall remit payment to the Beaufort County School District by the tenth of each month, in the amount provided for by contract or otherwise agreed upon.

(2)    Beginning October 1, 2006, Jasper County shall remit payment to the Beaufort County School District by the tenth of each month, based on the forty five-day count on a per student cost, as determined by the director and approved by the board."

SECTION    2.    Unless otherwise provided for, this act takes effect upon approval by the Governor.
