AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 20-3-135 SO AS TO PROVIDE THAT A MARRIAGE, OTHERWISE LAWFUL, THAT IS DECLARED VOID AB INITIO BY REASON OF FRAUD DOES NOT RELIEVE THE PARTY COMMITTING THE FRAUD OF THE DUTY TO PROVIDE SPOUSAL SUPPORT THAT WOULD HAVE OTHERWISE EXISTED.

Be it enacted by the General Assembly of the State of South Carolina:

Obligation to pay spousal support not eliminated when marriage voided due to fraud

SECTION    1.    Article 1, Chapter 3, Title 20 of the 1976 Code is amended by adding:

"Section 20-3-135.    A marriage that would otherwise be lawful that is declared void ab initio by reason of fraud, does not relieve the party committing the fraud of the duty to provide spousal support that would have otherwise existed pursuant to Section 20-3-130."

Time effective

SECTION    2.    This act takes effect upon approval by the Governor.

Ratified the 5th day of June, 2008.

Approved the 11th day of June, 2008.
