A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 12-28-317 SO AS TO ALLOW THE STATE BUDGET AND CONTROL BOARD TO SUSPEND TEMPORARILY ALL OR PART OF THE USER FEE ON MOTOR FUELS AND THE ROAD TAX ON MOTOR CARRIERS AND PROVIDE THE MAXIMUM DURATION OF ANY SUSPENSION AND THE CIRCUMSTANCES UNDER WHICH THE SUSPENSION MAY BE ORDERED.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 3, Chapter 28, Title 12 of the 1976 Code is amended by adding:

"Section 12-28-317.    (A)(1)    The State Budget and Control Board, by resolution, may suspend all or part of the user fee imposed pursuant to this article for not more than six calendar weeks upon a finding by the board in the resolution that:

(a)    the economic well-being of the people of this State requires the suspension; and

(b)    the suspension will not impair the credit of the State.

(2)    By a second resolution, the suspension allowed pursuant to item (1) of this subsection may be extended for not more than an additional six calendar weeks, but the total period of suspension in the most recently completed twelve calendar months may not exceed twelve calendar weeks.

(B)    The State Budget and Control Board may suspend all or part of the road tax on motor carriers imposed pursuant to Chapter 11 of Title 56 subject to the same terms and conditions provided pursuant to subsection (A) of this section for a suspension of the user fee on motor fuels."

SECTION    2.    This act takes effect upon approval by the Governor.
