A BILL

TO AMEND SECTION 44-96-150, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PACKAGING AND PLASTICS IN CONNECTION WITH SOLID WASTE MANAGEMENT, SO AS TO REQUIRE THAT PLASTIC BAGS PROVIDED BY A RETAILER MUST BE DEGRADABLE, BEGINNING IN 2012.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 44-96-150(C) of the 1976 Code is amended to read:

"(C)(1)    One year after this chapter is effective, no plastic bag shall be provided at any retail outlet to any retail customer for use in carrying items purchased by that customer unless the bag is composed of material which is recyclable.

(2)    Beginning January 1, 2012, a plastic bag must not be provided at a retail outlet to a retail customer for use in carrying items purchased by that customer unless the bag is composed of material that is degradable, as defined in Section 44-96-40(8)."

SECTION    2.    This act takes effect upon approval by the Governor and applies beginning January 1, 2012.
