A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 25-11-100 SO AS TO PROVIDE A BONUS TO VETERANS RETURNING HOME FROM ACTIVE DUTY SERVICE AS A RESULT OF THE SEPTEMBER 11, 2001, TERRORIST ATTACKS AND TO PROVIDE THAT THE BONUS AMOUNT IS EQUAL TO FIVE HUNDRED DOLLARS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 1, Chapter 11, Title 25 of the 1976 Code is amended by adding:

"Section 25-11-100.    (A)    Upon application, a veterans' bonus in the amount of five hundred dollars must be paid to any veteran, or to the dependents of a deceased veteran, if the veteran:

(1)    was a legal resident of South Carolina for at least six months immediately preceding entry into the armed forces, or a reserve component of the armed forces, of the United States or the South Carolina National Guard;

(2)    is still in, or was separated or discharged from the armed forces, a reserve component of the armed forces, or the South Carolina National Guard honorably or under honorable conditions; and

(3)    served for at least thirty days on active duty in the armed forces, or armed forces reserve component of the United States, or in the South Carolina National Guard, as a result of the September 11, 2001, terrorist attacks.

(B)    Applications must be filed with the Division of Veterans Affairs on forms to be furnished by the division. Proof of residency for veterans and familial relationship consists of information obtained from the Defense Enrollment Eligibility Reporting System (DEERS). Proof of active duty consists of a copy of the orders issued by an authorized headquarters ordering the member to this duty and documentation showing that this duty was actually performed. Eligible active duty includes any active duty since September 11, 2001."

SECTION    2.    This act takes effect upon approval by the Governor.
