A BILL

TO AMEND SECTION 40-43-83 OF THE 1976 CODE, RELATING TO PHARMACISTS, TO DELETE THE PROVISION THAT PROVIDES THAT THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL IS EXEMPT FROM THE REQUIREMENT THAT FACILITIES DISTRIBUTING OR DISPENSING PRESCRIPTION DRUGS MUST BE PERMITTED BY THE BOARD OF PHARMACY AND MUST HAVE A PHARMACIST-IN-CHARGE; AND TO AMEND SECTION 40-43-86, RELATING TO PHARMACISTS, TO DELETE THE PROVISION THAT THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL IS EXEMPT FROM THE REQUIREMENT THAT THE PHARMACIST IN CHARGE MUST BE PHYSICALLY PRESENT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1    SECTION 3 of Act 49 of 2007 that amends Sections 40-43-83 and 40-43-86 is repealed.

SECTION    2.    This act takes effect upon approval by the Governor.
