A BILL

TO AMEND SECTION 15-5-150 OF THE 1976 CODE, RELATING TO FOREIGN CORPORATIONS AS DEFENDANTS IN CIVIL ACTIONS, TO PROVIDE THAT A RESIDENT OF THIS STATE MAY ACT AS A CLASS REPRESENTATIVE IN A CLASS ACTION WHEN THE CLASS INCLUDES NON-RESIDENTS OF THIS STATE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 15-5-150 of the 1976 Code is amended to read:

"Section 15-5-150.    An action against a corporation created by or under the laws of any other state, government or country may be brought in the circuit court by:

(1)    By any resident of this State for any cause of action; or

(2)    a resident of this State may act as a class representative in a class action when the class includes non-residents of this State; or

(2) (3)    By a plaintiff not a resident of this State when the cause of action shall have arisen or the subject of the action shall be situated within this State."

SECTION    2.    This act takes effect upon approval by the Governor.
