TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 8-13-810 SO AS DEFINE "DIRECT INFLUENCE" AND TO PROHIBIT A BUSINESS OR A PERSON, OR THEIR IMMEDIATE FAMILY, WITH AN OWNERSHIP INTEREST IN A BUSINESS THAT HAS A NO-BID CONTRACT FROM MAKING A CAMPAIGN CONTRIBUTION TO A CANDIDATE FOR PUBLIC OFFICE WHOSE OFFICE GIVES OR WOULD GIVE HIM DIRECT INFLUENCE IN AWARDING A CONTRACT AND TO PROVIDE AN EXEMPTION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 7, Chapter 13, Title 8 of the 1976 Code is amended by adding:
"Section 8-13-810. (A) For purposes of this section, 'direct influence' means the action of direct approval or vote on matters involving the no-bid contract and includes influence exercised by members of the General Assembly or statewide constitutional officers.
(B) A business or a person, or their immediate family, with an ownership interest in a business that has a no-bid contract may not make a campaign contribution to a candidate for public office whose office gives or would give him direct influence in awarding a contract.
(C) The provisions of this section do not apply to municipal offices."
SECTION 2. This act takes effect upon approval by the Governor.
