A BILL

TO AMEND SECTION 1-11-730, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO ELIGIBILITY TO PARTICIPATE IN STATE INSURANCE PLANS, SO AS TO PROVIDE THAT AN ACTIVE, FULL-TIME PERMANENT EMPLOYEE OF A STATE-COVERED ENTITY APPROVED FOR DISABILITY RETIREMENT IS ELIGIBLE TO PARTICIPATE IN PLANS WITH STATE-PAID PREMIUMS IF THE DISABILITY IS THE RESULT OF AN INJURY ARISING OUT OF AND IN THE COURSE OF THE PERFORMANCE OF THE PERSON'S OFFICIAL DUTIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 1-11-730(C) of the 1976 Code is amended to read:

"(C)(1)        An active employee retiring with ten or more years of state-covered entity service credited under a state retirement system is eligible for state-paid premiums, if the last five years are consecutive and in a full-time permanent position with a state-covered entity.

(2)    An active, full-time permanent employee of a state-covered entity who is approved for disability retirement pursuant to Section 9-1-1540 or Section 9-11-80 is eligible to participate in the plans with state-paid premiums, regardless of the length of service, if the disability is the result of an injury arising out of and in the course of the performance of the employee's official duties during his or her state-covered entity service."

SECTION    2.    This act takes effect upon approval by the Governor and applies to all individuals meeting the statutory requirements on or after that date, regardless of the date of accident.
