TO AMEND SECTION 56-3-8710, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE ISSUANCE OF NASCAR SPECIAL LICENSE PLATES BY THE DEPARTMENT OF MOTOR VEHICLES, SO AS TO PROVIDE THAT A PORTION OF THE FEES COLLECTED FROM THE SALE OF THESE LICENSE PLATES MUST BE DISTRIBUTED TO THE SOUTH CAROLINA ASSOCIATION OF CHILDREN'S HOMES AND FAMILY SERVICES AND NO LONGER TO THE SOUTH CAROLINA CHILDREN'S EMERGENCY SHELTER FOUNDATION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 56-3-8710(C)(1) of the 1976 Code is amended to read:
"(1) one-half deposited in a special account, separate and apart from the General Fund, designated the 'South Carolina Children's Emergency Shelter Fund' established within and administered for use by the Department of Social Services. The Department of Social Services shall distribute at least one-half of the funds from the special account to the South Carolina Children's Emergency Shelter Foundation Association of Children's Homes and Family Services for the benefit of the South Carolina children's emergency shelters. Funds distributed to the South Carolina Children's Emergency Shelter Foundation Association of Children's Homes and Family Services may be used only for providing donations to support the South Carolina children's emergency shelters. Funds received by the South Carolina Children's Emergency Shelter Foundation Association of Children's Homes and Family Services pursuant to this section must be deposited in an appropriate nonprofit account designated by the South Carolina Children's Emergency Shelter Foundation Association of Children's Homes and Family Services;"
SECTION 2. This act takes effect upon approval by the Governor.
