A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 44-1-142 SO AS TO PROHIBIT RETAIL FOOD ESTABLISHMENTS FROM PREPARING, SERVING, OR OTHERWISE PROVIDING FOOD CONTAINING TRANS FATS, TO REQUIRE THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL TO ASCERTAIN THE USE OF TRANS FATS WHEN INSPECTING RETAIL FOOD ESTABLISHMENTS, AND TO PROVIDE A CIVIL FINE FOR VIOLATIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 1, Title 44 of the 1976 Code is amended by adding:

"Section 44-1-142.    (A)    Notwithstanding another provision of law, a retail food establishment as defined in Regulation 61-25 may not prepare, serve, or otherwise provide food containing trans fats.

(B)    The department in its initial permit inspection and in its routine inspections of retail food establishments shall determine whether the establishment prepares, serves, or otherwise provides food containing trans fats.

(C)    The department may impose a fine of up to five hundred dollars for a violation of this section."

SECTION    2.    This act takes effect ninety days after approval by the Governor.
