A BILL

TO DIRECT THE FAIRFIELD COUNTY TREASURER TO TRANSFER A SPECIFIED AMOUNT OF FUNDS TO CHESTER COUNTY SCHOOL DISTRICT IN ORDER TO DEFRAY THE COSTS TO EDUCATE CERTAIN STUDENTS WHO RESIDE IN FAIRFIELD COUNTY BUT ATTEND CHESTER COUNTY SCHOOLS, AND TO REQUIRE THAT THE AMOUNT OF FUNDS DELIVERED TO CHESTER COUNTY SCHOOL DISTRICT BE REEXAMINED EVERY THREE YEARS AND AN AGREEMENT BE ENTERED INTO BETWEEN THE SCHOOL DISTRICT OF FAIRFIELD COUNTY AND CHESTER COUNTY SCHOOL DISTRICT FOR THE PAYMENT OF THOSE FUNDS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Pursuant to an agreement entered into between the School District of Fairfield County and Chester County School District, the Fairfield County Treasurer shall transfer to Chester County School District monies to defray the cost to educate certain students who reside in Fairfield County but attend Chester County schools in the following amounts: one hundred thousand dollars by August 1, 2009, two hundred thousand dollars by May 1, 2010, and two thousand three hundred dollars per student who attends Chester County schools but resides in Fairfield County by May 1, 2011. By May 1, 2012, and every three years thereafter, the School District of Fairfield County and Chester County School District shall reexamine the amount of funds to be delivered to Chester County School District and shall enter into a new agreement for the payment of those funds.

SECTION    2.    This act takes effect upon approval by the Governor.
