TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA 1976, BY ADDING SECTION 11-11-250 SO AS TO PROVIDE THAT IN ANY FISCAL YEAR, ANY OTHER FUNDS RECEIVED BY ANY STATE AGENCY IN EXCESS OF THE FUNDS AUTHORIZED FOR EXPENDITURE IN THE ANNUAL APPROPRIATIONS ACT SHALL BE REMITTED TO THE GENERAL FUND.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 1, Chapter 11, Title 11 of the 1976 Code is amended by adding:
"Section 11-11-250. In any fiscal year, any other funds received by any state agency, department, board, institution, or commission in excess of the funds authorized for expenditure in the annual general appropriations act, or any appropriation act subsequent thereto, shall be remitted to the general fund of the State. For purposes of this section, 'other funds' means any revenues which are not federal funds and are not general funds appropriated by the General Assembly in the appropriations act."
SECTION 2. This act takes effect July 1, 2011.
