A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-5-581 SO AS TO PROVIDE THAT IT IS UNLAWFUL FOR A PERSON TO GIG FOR FLOUNDER IN SALT WATERS DURING DAYLIGHT HOURS, TO DEFINE THE TERM "DAYLIGHT HOURS", AND TO PROVIDE A PENALTY.

Amend Title To Conform

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 5, Chapter 5, Title 50 of the 1976 Code is amended by adding:

"Section 50-5-581.    It is unlawful for a person to gig for flounder in the salt waters of this State during daylight hours. For the purposes of this section, 'daylight hours' means that period of time between official sunrise and official sunset. Any person violating the provisions of this section, upon conviction, must be fined not more than one hundred dollars or imprisoned for not more than thirty days. For the purposes of this section, gigging does not include underwater spear fishing."

Section 2. This act takes effect upon approval by the Governor.
