A JOINT RESOLUTION

TO APPROPRIATE MONIES FROM THE CAPITAL RESERVE FUND FOR FISCAL YEAR 2013-2014, AND TO ALLOW UNEXPENDED FUNDS APPROPRIATED TO BE CARRIED FORWARD TO SUCCEEDING FISCAL YEARS AND EXPENDED FOR THE SAME PURPOSES.

Amend Title To Conform

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    In accordance with the provisions of Section 36(B)(2) and (3), Article III, Constitution of South Carolina, 1895, and Section 11-11-320(C) and (D) of the 1976 Code, there is appropriated from the monies available in the Capital Reserve Fund for Fiscal Year 2013-2014 the following amounts:

SECTION    2.    Funds appropriated above in Section 1, Item (11) to the Department of Commerce shall be used to fund, upon approval of the Secretary of Commerce and the Coordinating Council for Economic Development, partnerships between the Department of Commerce, higher education institutions, either collectively or individually, and South Carolina-based industry with significant investment in the state. These partnerships shall be in Distribution and Logistics Sciences, or any other science, technology, research, development, or industry that creates well-paying jobs and enhanced economic opportunities for the State as determined by the Secretary of Commerce. Unexpended funds shall be carried forward from the prior fiscal year into the current fiscal year and may be used for the same purpose or to fund economic development projects.

SECTION    3.    Funds appropriated above in Section 1, Item (15) are to be used solely for the purpose of maintaining the Pinewood Landfill. These funds are not subject to across the board budget cuts, nor can they be transferred to other agency programs. At the end of the fiscal year, any remaining balance must be transferred to the Hazardous Waste Permitted Site Fund and cannot be used for any other purpose. By July fifteenth of each year, the Department of Health and Environmental Control shall submit a report to the Chairman of the Senate Finance Committee and to the Chairman of the House Ways and Means Committee itemizing spending from any source by the department for the operation of the Pinewood Landfill during the prior fiscal year.

SECTION    4.    Funds appropriated above in Section 1, Item (52) to the State Ports Authority shall be placed in the Georgetown Port Maintenance Dredging Fund.

SECTION    5.    The Comptroller General shall post the appropriations contained in this joint resolution as provided in Section 11-11-320(D) of the 1976 Code. Unexpended funds appropriated pursuant to this joint resolution may be carried forward to succeeding fiscal years and expended for the same purposes.

SECTION    6.    This joint resolution takes effect thirty days after the completion of the 2013-2014 Fiscal Year in accordance with the provisions of Section 36(B)(3)(a), Article III, Constitution of South Carolina, 1895, and Section 11-11-320(D)(1) of the 1976 Code.
