A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING ARTICLE 2 TO CHAPTER 31, TITLE 23 SO AS TO REQUIRE THAT A PERSON OR ENTITY WHO MANUFACTURES IMITATION FIREARMS IN THIS STATE ONLY MAY MANUFACTURE IMITATION FIREARMS THAT ARE TRANSLUCENT OR PAINTED WITH BRIGHT COLORS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 31, Title 23 of the 1976 Code is amended by adding:

"Article 2

Imitation Firearms

Section 23-31-50.    As used in this article, the term 'imitation firearm' means any BB device, toy gun, or other device that is substantially similar in coloration and overall appearance to an existing firearm so as to lead a reasonable person to perceive that the device is a firearm.

Section 23-31-60.    A manufacturer of imitation firearms in this State only may manufacture, sell, or distribute an imitation firearm that is translucent or the entire exterior surface of the device is white, bright red, bright orange, bright yellow, bright green, bright blue, bright pink, bright purple, or any combination of the colors as provided by federal regulations governing imitation firearms."

SECTION    2.    This act takes effect upon approval by the Governor.
