A BILL

TO AMEND ARTICLE 43, CHAPTER 5, TITLE 56 OF THE 1976 CODE, RELATING TO THE ENFORCEMENT OF THE UNIFORM ACT REGULATING TRAFFIC ON HIGHWAYS, BY ADDING SECTION 56-5-6195, TO PROVIDE THAT THE DEPARTMENT OF PUBLIC SAFETY MAY IMPOSE A FINE OF TWO HUNDRED DOLLARS IN ADDITION TO THOSE PENALTIES PROVIDED IN SECTION 56-5-6190 IF A PERSON IS TRAVELING AT A SPEED OF OVER SEVENTY-FIVE MILES PER HOUR ON A TWO-LANE HIGHWAY OR AT A SPEED OF OVER EIGHTY-FIVE MILES PER HOUR ON A FOUR-LANE HIGHWAY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 43, Chapter 5, Title 56 of the 1976 Code is amended by adding:

"Section 56-5-6195.    (A)    In addition to the penalties provided in Section 56-5-6190, the Department of Public Safety may impose a fine of two hundred dollars if a person is:

(1)    driving more than seventy-five miles per hour on a two-lane highway; or

(2)    driving more than eighty-five miles per hour on a four-lane highway.

(B)    All fines collected pursuant to this section shall be deposited into the South Carolina State Trauma Care Fund."

SECTION    2.    This act takes effect upon approval by the Governor.
