A bill

 

TO AMEND THE SOUTH CAROLINA CODE OF LAWS BY ADDING SECTION 44-1-320 SO AS TO PROHIBIT THE CONSTRUCTION OR INSTALLATION OF SEPTIC TANKS WITHIN A CERTAIN PROXIMITY TO WATERWAYS OR THE COAST OF SOUTH CAROLINA.

 

Be it enacted by the General Assembly of the State of South Carolina:

 

SECTION 1.  Chapter 1, Title 44 of the S.C. Code is amended by adding:

 

    Section 44-1-320.  Notwithstanding another provision of law to the contrary, including any provision in Chapter 55, Title 44, or in Titles 5 or 6, the Department of Health and Environmental Control, or its successor agency, shall not permit the construction or installation of septic tanks within a two-mile straight-line distance of any waterway or the coast of South Carolina.

 

SECTION 2.  This act takes effect upon approval by the Governor.
