EXECUTIVE ORDER NO. 97-04


WHEREAS, an election was held in Newberry County School District 3 on November 5, 1996, resulting in the election of Mr. Randy Ruff; and

WHEREAS, the election was protested by Mr. Thomas Crooks to the Newberry County Board of Canvassers, which appeal was denied; and

WHEREAS, a hearing was held on November 9, 1996 before the State Board of Canvassers, South Carolina Election Commission, resulting in the reversal of the decision of the Newberry County Board of Canvassers and the ordering of a new election; and

WHEREAS, pursuant to SC Code Ann. Section 7-13-1170 (Cum. Supp. 1995), the Governor is authorized to order an election when an election is declared void by competent authority, and these facts are made to appear to the satisfaction of the Governor.

NOW, THEREFORE, by virtue of the authority vested in me by the Constitution and Statutes of the State of South Carolina, it is Ordered that the Newberry County Registration and Election Commission schedule an election for Newberry County School District 3 to be held on April 1, 1997. It is further Ordered that the Newberry County Registration and Election Commission shall take all steps necessary to schedule and hold this election. It is further Ordered that the Newberry County Registration and Election Commission shall take such action to insure that the list of registered voters is as accurate as possible.
