Amend the bill, as and if amended, Section 12-36-2691, as contained in SECTION 4, by adding an appropriately lettered subsection to read:
/ (___) Notwithstanding another provision of law, if the owner or operator of the distribution facility fails to meet any of the requirements of Section 12-36-2691, the owner or operator of the distribution facility must reimburse the state for all costs associated with the distribution facility and must pay the State treble the amount of taxes that would have been required to be collected if the distribution center had not received the sales and use tax exemption provided in Section 12-36-2691. /
