EXPLANATION: Prohibt contractors, subcontractors or MCOs from restricting the ability of a pharmacy provider from disclosing information to a Medicaid beneficiary or participant in the SHP
Amend the bill, as and if amended, Section 117, GENERAL
PROVISIONS, page 510, after line 3, by adding an appropriately
numbered paragraph to read:
/(GP: Prescription Drug Disclosures) With the funds
appropriated and authorized to the Department of Health and
Human Services and the Public Employee Benefit Authority, the
agencies shall prohibit any contractor, subcontractor, or
managed care organization (MCO) from restricting the ability of
a pharmacy provider from disclosing information to a Medicaid
beneficiary or participant in the state health plan regarding
the cost of a prescription drug, the availability of
therapeutically equivalent alternatives to a prescription drug,
or providing a more affordable alternative if one is available.
Nothing in this provision is to be construed as expanding,
restricting, or otherwise altering a pharmacy provider's scope
of practice, nor shall the provision be construed as to require
the pharmacy provider to disclose such information to a Medicaid
beneficiary or participant in the state health plan. The
Department is authorized to make such state plan, policy, or
contract amendments necessary to implement these
provisions./
