EXPLANATION:

Amend the bill, as and if amended, Part IB, Section 109, DEPARTMENT OF REVENUE, page 457, paragraph 109.10, after line 9, by adding a subsection to read:

/      (K)      For purposes of the tax credit allowed by subsection (H)(2) and without regard to the limitations set forth in subsection (D)(1)(b), the shifting of a qualifying student from one qualifying school to another qualifying school within a school year shall not impact the amount of credit allowed.            /

Renumber sections to conform.
Amend totals and titles to conform.
