    Amend the bill, as and if amended, page 5, by striking lines 28 through 32, in Section 22-5-930(B), as contained in SECTION 4, and inserting there in the following:
    /         drug conviction or any felony conviction may apply, or cause someone acting on his behalf to apply, to the circuit court for an order expunging the records of the arrest and conviction and any associated bench warrant.         /

    Amend the bill further, as and if amended, page 5, by striking lines 39 through 40, in Section 22-5-930(D), as contained in SECTION 4, and inserting therein the following:
    /         (D)     No person may have the person's record expunged under this section if the person has pending criminal charges of any kind unless the charges have been pending for more than five years; however, this five year time period is tolled for any time the defendant has been under a bench warrant for failure to appear. No         /
    Renumber sections to conform.
    Amend title to conform.
