    Amend the bill, as and if amended, page 2 by striking lines 8-15 and inserting therein:
    /         (B)(1)     A person who is charged with violating subsection (A) may, as a condition of his bond, be required to undergo a mental health evaluation. The purpose of this evaluation is to determine if the defendant needs mental health treatment or counseling. When the court requires a mental health evaluation, the evaluation may not take place until the facility conducting the evaluation has received all of the documentation including, but not limited to, warrants, incident reports, and NCIC reports associated with the charges. If the mental health evaluation reveals that the person needs mental health treatment or counseling, then the solicitor may refer him to a mental health court or the court may require him to undergo mental health treatment or counseling by a court-approved mental health professional, mental health facility, or facility operated by the State Department of Mental Health as a condition of his bond or as a condition of probation.     /
