View Amendment Current Amendment: 2 to Bill 201

Senator FANNING proposed the following amendment (201MF2):

Amend the bill, as and if amended, by striking Section 59-18-1640(E)(1) and inserting the following:

/ (E)(1)    All roles and responsibilities for the operation and management of the school district by the local board of trustees are suspended upon the State Board of Education's approval of a state-of-education emergency declaration and the expiration of the ten business day appeal window or upon an affirmative decision by the Administrative Law Court. The State Superintendent of Education shall assume the authority and responsibilities of the district superintendent and the State Board of Education will assume the authority and responsibilities of the local board of trustees until the state-of-education emergency is lifted.

(2)   Once a district subject to subsection (C) has met annual targets identified in the district's revised strategic plan for sustained improvement for a minimum of three consecutive years, the State Superintendent of Education shall submit to the State Board of Education documentation of such. The State Board of Education shall approve that the management and operation of the school district shall be returned to the local board of trustees.

(3)    For a maximum of three years and until the State Board of Education votes to end the state-of-education emergency, the local district board shall remain in suspension during which time they will be required to attend professional development opportunities, included but not limited to, roles and responsibilities of the school board, education funding, the Education Accountability Act and financial accountability laws, approved by the State Board of Education ./

Further amend the bill, as and if amended, by striking Section 59-18-1640(F) and inserting the following:

/ (F)(1)    Upon an affirmative vote by the State Board of Education to end the state-of-education emergency, the department, in consultation with the district, shall develop a transition plan and timeline for returning management of the district to a the local board of trustees.

(2)    Upon the declaration of a state-of-education emergency being lifted, the powers and duties of the district superintendent and local district school board of trustees are restored. /
