Rep. ROBINSON proposes the following Amendment No. to S. 200 (COUNCIL\AHB\200C005.BH.AHB21):

Amend the bill, as and if amended, striking all after the enacting words and inserting:

/ SECTION1. The General Assembly finds

that the imposition of the death penalty by any means is so horrific and inhumane as to constitute a per se violation of the eighth amendment of the United States Constitution, an important tenet of the Bill of Rights.

SECTION 2. Article 5, Chapter 3, Title 24 of the 1976 Code is repealed.

SECTION3 .This act takes effect upon approval by the Governor and applies to persons sentenced to death as provided by law prior to and after the effective date of this act. Those persons sentenced to death prior to the repeal of Article 5, Chapter 3, Title 24 of the 1976 Code must have their sentences automatically converted to life imprisonment without parole. /
