Rep. McCRAVY proposes the following Amendment No. to H. 3050 (COUNCIL\WAB\3050C001.RT.WAB21):

Amend the bill, as and if amended, SECTION 3, Section 23-1-250(B), by striking the subsection and inserting:

/ (B) The use of a chokehold or carotid hold is justifiable only if a law enforcement officer reasonably believes that the use of a chokehold is necessary to protect a civilian or a law enforcement officer from serious bodily harm. The substantiated use of an unjustified chokehold or carotid hold shall be deemed excessive force and may result in criminal prosecution. /
