Senator Kimbrell proposes the following amendment (SR-3571.CEM0003S):

Amend the bill, as and if amended, SECTION 1, by striking Section 58-36-20(4) and inserting:

  (4) road and right-of-way maintenance activities by a governmental entity responsible for the maintenance of those roads and rights-of-way, within the designated right-of-way of such entity, including limited to resurfacing, milling, or emergency replacement of signs critical for maintaining safety, and the reshaping of shoulders and ditches to the original road profile; provided, however, this subsection shall not apply to contractors or subcontractors acting on behalf of an entity pursuant to this subsection, unless such contractor or subcontractor is performing a repair related to a gubernatorial declared emergency or an emergency declared by the Secretary of Transportation.
