Rep. MARTIN proposes the following amendment (LC-4757.DG0005H):
Amend the bill, as and if amended, SECTION 2, Section 59-28-350, by adding a subsection to read:
(D) A parent may appeal the final decision of the State Board to the Administrative Law Court and pursue all judicial reviews and appellate remedies of the court's decision as provided for in the Administrative Procedures Act.Amend the bill further, SECTION 2, by striking Section 59-28-350(E)(1) and inserting:
(E)(1) After all available administrative remedies described in subsections (B), and (C), and (D) have been fully exhausted, a parent may bring a private cause of action in circuit court against the LEA and may recover declaratory relief, injunctive relief, liquidated damages of five thousand dollars per violation, and reasonable attorney's fees and costs.Renumber sections to conform.
