Rep. FORD proposes the following amendment (LC-3924.PH0027H):
Amend the bill, as and if amended, SECTION 39, by striking Section 61-14-920 and inserting:
Section 61-14-920. (A) Hemp-cannabinoid beverages in a 750-milliliter bottle, a single serving can or bottle containing more than five milligrams but not more than ten milligrams of an allowable THC concentration, or a hemp gelatin chewable as permitted by this chapter mustmay be sold only inat:(1) licensed alcoholic liquor stores; or
(2) licensed hemp-specialty retailers as authorized by Article 11, Chapter 14, Title 61.
(B)(1) Established licensed under subsection (A) to sell hemp-cannabinoid beverages containing more than five milligrams, but not more than ten milligrams, of allowable THC concentration per serving may not be located within one thousand feet of:
(a) an elementary, middle, or high school; or
(b) a church or other place of worship.
(2) The distance prescribed in item (B)(1) must be measured following the shortest route or ordinary pedestrian travel from the main entrance of the licensed establishment to the nearest property boundary of the school or church.
(3) The distance requirement applies to new license applications submitted after the effective date of this section. An existing licensed establishment that is lawfully operating as of the effective date of this section may continue to operate at its current location.
