Rep. WETMORE proposes the following amendment (LC-508.SA0027H):
Amend the bill, as and if amended, SECTION 2, by striking Section 10-1-165(C) and inserting:
(C)(1) The prohibition on disturbing or altering a monument or memorial contained in this section includes affixing to or placing on or near a monument or memorial, or the public property upon which the monument or memorial is located, plaques, markers, anything that facilitates the transmission of messages through digital or electronic means, or other messages or message delivery devices or platforms that are related to the monument or memorial but are not original to the monument or memorial.(2) Nothing in item (C)(1) may be construed to prohibit temporary, nonpermanent expressive materials, including signs, panels, projected images, messages conveyed through digital or electronic means or displays, or other messages, delivery devices, or platforms used in connection with a lawful protest, commemorative event, educational event, or other event lawfully permitted or otherwise lawfully authorized and conducted, provided that the event or materials:
(a) do not physically alter, damage, deface, or permanently affix to the monument or memorial;
(b) comply with all otherwise applicable time, place, and manner restrictions and permitting requirements imposed by this title or by any other provision of South Carolina law or any applicable county or municipal code, ordinance, or regulation; and
(c) are removed at the conclusion of the permitted or authorized event.
