Rep. T. MOORE proposes the following amendment (LC-4764.AHB0013H):
Amend the bill, as and if amended, SECTION 1, by striking Section 23-1-260(I) and inserting:
(I) A law enforcement officer, government official or employee of this State or political subdivision of this State, acting in good faith to enforce immigration laws under an agreement entered into under this section, and any agency, department, county, municipality, political subdivision, or other governmental entity of this State that enters into or acts in good faith pursuant to such an agreement, is immune from damages or liability arising from and act or omission occruing within the scope of the agreement. However, if the act was done outside the scope of his official duties or which constitutes actual fraud, actual malice, intent to harm, or a crime involving moral turpitude the law enforcement officer or government official or employee is not immune from damages or liability.Renumber sections to conform.
