Rep. RUTHERFORD proposes the following amendment (LC-3034.AHB0007H):
Amend the bill, as and if amended, SECTION 2, by adding:
Section 47-3-640. A law enforcement officer handler must obtain clearance from his immediate supervisor before engaging a police dog in a situation that is potentially deadly to the dog, and the officer must afterwards file a report with a detailed accounting and explanation of the reasons for the engagement of a police dog. Additionally, in such a situation in which a police dog is engaged in a pursuit, the police dog must be on a tether. The law enforcement agency shall notify the State Law Enforcement Division (SLED) within thirty days of the engagement and provide a copy of the officer's report. SLED shall collect and store such reports which are subject to the provisions of Chapter 4, Title 30, the Freedom of Information Act.Renumber sections to conform.
