A BILL TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION

A BILL

1976, BY ADDING SECTION 59-39-315 SO AS TO PROVIDE

SECONDARY SCHOOL WHO IS AT LEAST FIFTEEN YEARS
OF AGE AND WHO IS NOT LICENSED TO DRIVE A MOTOR
VEHICLE IN THIS STATE MAY ENROLL IN THE DRIVER
EDUCATION AND TRAINING PROGRAM OF A PUBLIC
SCHOOL WITHIN THE SCHOOL DISTRICT IN WHICH HE
RESIDES OR IS ELIGIBLE TO ATTEND THE SCHOOLS
THEREOF SUBJECT TO CERTAIN CONDITIONS.
Be it enacted by the General Assembly of the State of South
Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 59-39-315. Any student attending a private or church
secondary school who is at least fifteen years of age and who is not
licensed to drive a motor vehicle in this State may enroll in the driver
education and training program of a public school within the school
district in which he resides or is eligible to attend the schools thereof
subject to the following conditions:
(1) the private or church school he attends does not offer a
comparable driver education and training program;
(2) no driver training school licensed pursuant to Chapter 23 of
Title 56 operates or is located within that school district;
(3) the school and school district are not responsible for providing
any transportation to or from the driver education and training
classes; and
(4) any fees and costs required of a regularly-enrolled student at
that public school also must be paid by the private or church school
student. Otherwise, no fees or costs to attend such driver education
and training classes may be required."
SECTION 2. This act takes effect upon approval by the Governor.
